President Trump has repeatedly invoked the International Emergency Economic Powers Act (IEEPA) to increase tariffs on US imports at levels not seen since the 1930s. These tariffs are unprecedented and harm American companies and consumers, as well as the broader economy. The Supreme Court is expected to rule on the legality of the IEEPA tariffs before mid-2026. If the IEEPA tariffs are invalidated, the president could resist issuing quick refunds to affected importers, and he will likely resort to other executive authorities to create a tariff regime of similar scope and magnitude. Congress must therefore act to prevent the continued abuse of presidential tariff powers.
