Does the American Criminal Justice System Need an Overhaul?

Judge Alex Kozinski recently published a scathing critique of the American criminal justice system in an article titled “Criminal Law 2.0.” According to Judge Kozinski, we should be alarmed by the number of people who have been exonerated by DNA testing. That testing has exposed a system that is rife with false confessions, unreliable eyewitnesses, junk forensics, and misbehaving prosecutors, among other problems. Judge J. Harvie Wilkinson, on the other hand, says critics have exaggerated the problems and ignored the virtues of our institutions. Although the American criminal justice system has its share of failings, it gets a lot of things right and is thus worthy of our admiration and respect.
