In his new analysis, Lett explains how the One Big Beautiful Bill gave ICE $75 billion outside the normal appropriations process. This means ICE and CBP can continue operations regardless of whether Congress passes a DHS funding bill.
Beyond the immediate shutdown drama, Lett identifies a troubling trend: both parties now routinely use budget reconciliation to bypass fiscal constraints and Congressional oversight. The result is weaker checks and balances and diminished fiscal responsibility.
