Recent information released by the House Judiciary Committee revealed that in 2022, the Justice Department subpoenaed all of Rep. Jim Jordan’s call logs from the previous two years in a drastic encroachment into the legislative branch.
In a recent blog post, Cato Institute legal scholar Brent Skorup details the serious concerns arising from this case regarding the Justice Department’s investigative approach, as well as the need to constrain investigative power in the digital age:
“The Arctic Frost investigation underscores the urgent need to reexamine and limit how investigative power is exercised in the digital age. If the executive branch can secretly collect years of communications and financial records from anyone — even lawmakers — it erodes the protections afforded by the Fourth Amendment.”
