The Department of Justice is suing Maine’s Department of Educational for failing to comply with banning transgender athletes from women’s sports.

Neal McCluskey, the director of Cato’s Center for Education Freedom, has written on this in the past. In his previous blog post, he commented on the initial executive order saying that the issue should be left up to lower levels of government and society.

He states, “This would allow decisions to be made more consistent with the unique problems and character of specific communities and provide a multiplicity of approaches that might reveal solutions no central authority has thought of.”

McCluskey emphasized the importance of choice in education, allowing individual families or students to decide what schools they will use, including based on interscholastic athletics policies.
