The rumors of the death of the Privileges or Immunities Clause have been wildly exaggerated. It’s back. Thanks largely to the originalist concurrence of Justice Clarence Thomas, the clause has gained new life. Alan Gura argued the McDonald gun case before the U.S. Supreme Court.
