As Roger Pilon [mentioned](https://www.cato.org/2010/08/03/taking-the-constitution-seriously/), yesterday’s *Politico* question was “Is Health Care Repeal Gaining Steam?” A timely question in light of Monday’s court decision allowing a lawsuit against the health care mandate to proceed.

And perhaps an even more timely question today, now that 71 percent of Missouri voters [have voted for a proposition](http://www.stltoday.com/news/local/govt-and-politics/article_c847dc7c-564c-5c70-8d90-dfd25ae6de56.html) to exempt the state from the mandate.

Polls show [continuing opposition](https://www.cato.org/2010/07/26/obamacare-remains-unpopular-or-round-two-of-my-exchange-with-maggie-mahar/) to the Obama-Reid-Pelosi health care overhaul. It’s [constitutionally dubious](https://www.cato.org/2010/07/24/randy-barnett-in-the-wall-street-journal-a-commandeering-of-the-people/). And now, in the only popular vote on the bill, it received a full 29 percent of the vote. Just maybe this wasn’t a good idea.
