By a razor thin vote (5–4), the Supreme Court decided the case of *Hudson v. Michigan*. Justice Stephen Breyer’s [dissenting opinion](http://www.supremecourtus.gov/opinions/05pdf/04-1360.pdf#page=31) (bottom of the page) cites [Radley’s article](https://www.cato.org/pub_display.php?pub_id=6344) about the stakes involved in this case. Congrats to Radley!

We’ll have more to say about today’s awful ruling later …
