# Employer Liability Is Not an Adequate Solution to Qualified Immunity 

Qualified immunity denies Americans justice by unlawfully shielding government officials from being held liable for violating people’s constitutional rights. As applied to police, the practical effect of this doctrine has been to severely undermine public trust in law enforcement.

One “compromise” solution some have proposed in response to public demands to end qualified immunity is to instead make police departments themselves, rather than individual officers, directly liable to victims of misconduct. But while employer liability is part of the solution to qualified immunity, it is not an adequate solution on its own.
