Will Congressman Tom Marino be the Trump Administration’s Drug Czar?

CBS reports that President Trump plans to name Congressman Tom Marino (R-PA) to head the Office of National Drug Control Policy, an office colloquially known as the federal government’s “Drug Czar.”

Rep. Marino has a long history of taking a hard line on the drug war. He voted against the Rohrabacher-Farr Amendment that barred the Department of Justice from spending federal funds to prosecute state-legal medicinal marijuana operations. The amendment, which has passed several times with bipartisan support, allows state medical marijuana industries to function without the constant fear of federal prosecution. Rep. Marino also voted to prevent Veterans’ Affairs doctors at facilities in states with legal marijuana from prescribing medical marijuana to their patients.

While the Drug Czar has a limited impact on policy, the expected nomination of Rep. Marino is another red flag for marijuana reform advocates.

44 states and the District of Columbia allow some form of legal cannabis consumption, including eight states (and D.C.) which have legalized the recreational use of marijuana. The dire predictions of drug warriors in those states have not come true.

As we’ve noted before, Donald Trump campaigned on a relatively moderate platform regarding marijuana legalization, but his choices for key drug policy positions in the administration continue to raise the specter of a federal crackdown on marijuana reform efforts.

Of course the drug war isn’t just about marijuana.  A new Cato policy analysis from Christopher J. Coyne and Abigail R. Hall demonstrates how four decades of a hardline approach to drug policy in America have failed. 

With a growing heroin and opioid epidemic, it’s time to ditch the failed prohibitionist policies of the drug war. Countries like Portugal have successfully abandoned the militarized approach to drug policy; it’s time for the United States to do the same. 

Unfortunately, President Trump appears to be moving in the wrong direction.

The Balloon Effect in Cocaine Production in the Andes

The Wall Street Journal has a lengthy story today [requires subscription] about the booming cocaine business in Peru, where production has skyrocketed in recent years. The report serves a reminder of the balloon effect in U.S.-led efforts to eradicate cocaine production in the Andean region. Gil Kerlikowske, the Obama administration’s drug czar, has repeatedly pointed out that production in Colombia dropped by 61 percent between 2001 and 2009. But as the graph below illustrates, cocaine manufacturing has just moved back to Peru, which according to some estimates, might already be the world’s largest producer of cocaine:

As we can see, Peru was the world’s largest source of potential cocaine production back in the early 1990s, but production of coca moved to Colombia once the regime of Alberto Fujimori cracked down on drug trafficking. By 2000, Colombia was by far the largest producer. However, due to eradication efforts by then president Álvaro Uribe under the U.S.-sponsored Plan Colombia, production came down in that country. But it didn’t go away, it just moved back to Peru. Overall, the World Drug Report by the UN Office on Drugs and Crime estimates that cocaine production levels in the Andes are pretty much the same as a decade ago.

Mr. Kerlikowske should present the whole picture next time he boasts about declining cocaine production in Colombia.

Spain’s Former Drug Czarina Endorses Legalization

Quoting great classical liberal minds such as Milton Friedman, Gary Becker and Mario Vargas Llosa, Spain’s former drug Czarina Araceli Manjón-Cabeza endorsed drug legalization today in a compelling op-ed [in Spanish] published in El País, Spain’s leading newspaper. Just a week earlier, Felipe González, Spain’s former Primer Minister, also came out in support of drug legalization.

Manjón-Cabeza takes particular aim at the UN International Narcotics Control Board for its criticisms of the different decriminalization and harm-reduction policies implemented in recent years in Argentina, Mexico, Brazil, and Spain, among other countries. She calls the INCB’s views “inadmissible.”

She concluded by calling prohibition a “savage and inefficient instrument that is not the ‘solution’ but instead a big part of the problem.” Manjón-Cabeza says that insisting on prohibitionist policies amounts to “insanity.” Finally, some common sense talk from a former drug czar.

Obama’s ‘New’ Drug Strategy

Ho-hum. Another administration, another “comprehensive plan to combat drug abuse, putting the focus on prevention and treatment strategies.” This one “calls for a 15 percent reduction in youth drug use, a 10 percent decrease in drugged driving, and a 15 percent reduction in overall drug-related deaths by 2015.” It involves more central planning – “ the creation of a community-based national prevention system” – more taxpayers’ money – “an expanded array of intervention-oriented treatment programs” – and more nannyism – “a push to screen patients early for signs of substance abuse, even during routine appointments, and the expansion of prescription-drug monitoring programs.” And don’t forget the ever-popular, ever-futile “more international cooperation in disrupting the flow of drugs and money.” Let’s write down those percentage goals, modest as they are, and see how many of them get accomplished.

As it happens, I had a chance to meet with drug czar Gil Kerlikowske and his top aides last year, as part of a series of outreach meetings as the new team planned its strategy. It doesn’t look like my advice was taken. Of course, I probably didn’t help my case by noting that our last three presidents have acknowledged using illegal drugs, and it is just incomprehensible to me how they can morally justify arresting other people for doing the same thing they did. Do they think that they would have been better off if they had been arrested and incarcerated for their youthful drug use? Do they think the country would have been better off if they had been arrested and incarcerated? If not, how do they justify punishing others?

I then suggested that they pursue the policies recommended by Timothy Lynch and myself in the Cato Handbook for Policymakers:

● repeal the Controlled Substances Act of 1970,

● repeal the federal mandatory minimum sentences and the federal sentencing guidelines,

● direct the administration not to interfere with the implementation of state initiatives that allow for the medical use of marijuana, and

● shut down the Drug Enforcement Administration.

Suspecting that the administration despite being headed a young president who in 2004 had declared the war on drugs an “utter failure” and advocated the decriminalization of marijuana, would not adopt my proposals, I went on to recommend a few mildly ameliorative reforms: stop federal lobbying in state initiative campaigns, stop federal raids on medical marijuana dispensaries and other interference with state policy choices, and stop the Pentagon from giving military equipment to local police forces.

I must admit, though, that the other think tank analysts at the meeting, both liberal and conservative, offered the sorts of proposals for more social workers and more transition programs and more doctors that seem to have ended up in the “new” proposal. Perhaps I should have come up with a couple of proposals that would have cost more money rather than less.
