On Tuesday the Obama administration changed tunes from his campaign rhetoric and did nothing to change the government’s position on the [State Secrets Privilege](http://en.wikipedia.org/wiki/State_Secrets_Privilege). A government lawyer [told the Court of Appeals for the Ninth Circuit](http://www.nytimes.com/2009/02/10/us/10torture.html?scp=1&sq=state%20secret&st=cse) that the government was continuing to assert the controversial defense to a civil suit arising from the extraordinary rendition program.
