Whereas [Randy Barnett](https://www.cato.org/people/randy-barnett) has championed a [“presumption of liberty”](http://store.cato.org/index.asp?fa=ProductDetails&method=cats&scid=37&pid=1441192) whenever a constitutional controversy is unclear, Sunstein seems to champion a “presumption for the state.”
