The high court has ruled that the ATS generally doesn’t cover conduct abroad, and that foreign companies can’t be liable under this law, but what about the liability of U.S. companies for foreign conduct?
The Montana Supreme Court struck down that state’s tax‐credit program because some beneficiaries used its scholarships to attend parochial schools. The U.S. Supreme Court will now review whether that violates equal protection.
Either President Obama didn’t have the power to implement DACA or the immigration laws themselves unconstitutionally give the president lawmaking power. So of course President Trump can wind DACA down.
